About Us

In these terms, we refer to ourselves as "BooknGo," "we," "us," or "our." We operate in Greece.

About You

You are a hair salon, spa, barbershop, nutritionist, physiotherapist, beauty center, barber shop, salon, or a store, business, or company related to nails, tattoos, piercings, eyebrows, lips, massage, makeup, or another business ("Beauty and Wellness Store") that enters into an agreement with BooknGo to use our services. In these terms, we will refer to you as "Partner," "you," or "your."

About Your Clients

"Client" refers to anyone who books your services through the various booking methods we provide.

The Terms

These terms include the Partnership Agreement Terms that we have established, as well as other terms that are referenced or incorporated in them. The partnership agreement terms, the "PRO" service terms, and the "Recommended" service terms define the services we provide to you. Any agreements outside of these Terms are not valid.

About the Services

Our services include tools and technologies to help you manage your business and promote it to your clients. We also provide technical support via email for our services.

Communication

We may contact you regarding booking issues or other services through the website, app, email, phone, SMS, Viber, or Telegram.

Service Descriptions

  • Management Software: A software that helps manage and grow your business, including tools such as Point of Sale (POS). The software also includes the use of BooknGo APIs, which we continually improve.
  • Marketplace: The booking platform through the website bookngo.gr and our app, where your services are advertised to a wide audience. We offer:
  • Partner Page: A customizable website that hosts your services.

Third-Party Providers

Through partnerships with technology providers like Google Maps and Apple Maps, your store can appear on these platforms to facilitate bookings.

Management Software

License to Use: The Management Software you have purchased and we have provided is non-transferable, exclusively yours, and is to be used solely by the partner and no one else.

Administrator Access: We use third-party technology to operate the Management Software, which allows us full administrative access to the software, including data created specifically for you. We will monitor your software usage with third-party tools to understand how it is used and how it can be improved. You do not have the right to access the monitoring data and cannot request to opt out of this process.

Marketplace

Bookings: Customers can book your services through our Marketplace (website, app, Partner Page). They can choose to pay with "Pay at Store."

Booking Terms and Obligations

  • Acceptance of Bookings: You must accept all bookings and can only reject them in exceptional cases, informing us in writing of the reasons for the rejection.

Reviews and Ratings

  • Search Ranking: Customers view your services based on various factors, including your availability, cancellations, reviews, and offered discounts.
  • Customer Reviews: Customers can leave reviews for your services, which you can view. We are not responsible for any losses (e.g., moral or financial) related to reviews, and you understand that they may contain negative feedback.
  • Defamatory Reviews: If you believe a review is defamatory or inaccurate, you can notify us. We will investigate and decide on appropriate actions, including removing the review if necessary.

Service Level

Proper Functioning: The software we provide is offered "as is" and "as available." We will make every effort to ensure "Proper Functioning" regarding its features, performance, or stability. We will strive to ensure uninterrupted operation to minimize any losses (data, bookings) that may result from downtime. You are responsible for ensuring your business can continue to operate even if the software experiences a temporary failure. In case of service unavailability, you will not be entitled to a refund of charges.

Improvements: If the services you receive do not meet the expected standards, we will review the issue and make necessary improvements where possible.

Charges and Payment

  • Charges: You agree to pay the charges made with your purchase for the annual or monthly subscription services we provide. These charges are non-refundable.
  • Free Trials: If you are provided with a free trial, charges will apply immediately after the trial period ends, and you must pay the corresponding amount.
  • Invoicing and Payments: Charges will be invoiced according to the agreed schedule. You must settle invoices promptly and without any rights of offset. Any dispute regarding invoices must be communicated immediately or within 14 days of receipt. The Partner has the right to withdraw within 14 days from the date of the invoice issuance.
  • Late Payments: We will charge interest on late amounts at a rate of 4% above the central bank’s base rate. We may also charge you for the costs of collecting overdue amounts. If there are unpaid invoices, we may restrict your services to prepayment.
  • Taxes: You are responsible for charging and managing VAT and other taxes and for providing receipts to your customers.

General Obligations

  • You must clearly display your business identity and address to customers and ensure that you have the necessary licenses.
  • You are not allowed to direct customers to your own website or other platforms via the Partner Page.
  • You must ensure that all the information you provide is accurate and not misleading.
  • Your services must be offered at the best available price on the Marketplace.
  • You are prohibited from asking customers to make bookings outside of the Marketplace or encouraging them to cancel their bookings to book directly with you.
  • All bookings must be added to the BooknGo calendar.
  • You cannot use third-party software to accept bookings.

Data Protection and Management

  • You are responsible for backing up your data, and we are not liable for any losses resulting from your failure to do so.
  • Any attempt to extract source code from our website and applications is prohibited.
  • The API license cannot be transferred to third parties, nor can solutions be created for third-party use.

Customer Service

You agree to:

  • Provide your services to customers in accordance with the highest industry standards, responding quickly to any queries or issues regarding your services and bookings.
  • Treat customers fairly, ethically, and responsibly, ensuring that your service promotes a positive image of the beauty, wellness industry, and BooknGo.
  • Address customer complaints promptly. If we receive a complaint directly, we will forward it to you.
  • Make every effort to resolve complaints as soon as possible and keep us informed of the resolution status upon request.

Usage Restrictions

When using our services, you may only send communications to customers who have expressly given their consent, in compliance with GDPR. Customers who have provided consent may receive promotional emails only from us.

Representations and Warranties

You represent and warrant that:

  • All content you provide to us or publish on our website and applications is accurate, truthful, and does not infringe third-party rights, nor is it defamatory, illegal, or offensive.
  • You comply with all applicable laws and regulations, including local, international, and European regulations, as well as rules regarding truth in discounts and advertisements.
  • You possess all necessary licenses, qualifications, and insurance for the services you provide.
  • You organize your business processes to comply with all regulatory requirements.
  • You have ensured that neither you nor your employees have been convicted of offenses related to slavery or human rights, and you maintain policies that ensure compliance with anti-corruption legislation.

Your Content

  • Provision of Partner Content: You will provide us with the necessary content in a timely manner to allow us to offer our services.
  • Content You Upload: You must ensure that you have all the rights to the content you upload, including publishing rights. The content must not promote violence, hate, or contain illegal material. If there is a violation, we may remove the content and take additional measures.

License to Use

You grant us the right to use, reproduce, and distribute your content on our website and applications, and for any business purpose. This license remains in effect even after the end of our collaboration.

Intellectual Property

BooknGo Rights:

Under our agreement, all rights to the Management Software, the Marketplace, the Partner Page, and its content (including Customer Reviews), as well as all associated intellectual property rights that belong to or have been granted to BooknGo, remain ours. You are not granted any rights regarding this intellectual property, including:

  • Licensing, selling, leasing, transferring, or otherwise disposing of the services to third parties.
  • Copying, modifying, republishing, or distributing any part of our services in any way.
  • Accessing or retrieving our services to develop competitive software.

Website/Application Updates

We reserve the right to modify the layout, content, and descriptions of your page to improve the website, applications, and their content.

Duration and Termination of Agreement

  • Duration: The agreement begins upon acceptance of the Terms and remains in effect until terminated under the terms.
  • Termination for Serious Cause: We may terminate the agreement immediately if you breach the terms seriously or persistently, fail to pay your bills, defame the company or the industry, or engage in illegal or unethical activities that harm us, customers, or staff.

Access Suspension

We reserve the right to suspend your access to the services if:

  • You attempt to avoid paying bills.
  • You do not accept bookings or encourage customers to cancel bookings via our website and applications.
  • You violate terms regarding data protection or customer reviews.

Obligations After Termination

  • Outstanding Balances: If there is any outstanding balance after the termination of the agreement, you must pay it within 14 days.
  • Data: After termination, you lose access to the services and must download your data in advance.
  • Survival of Terms Clauses: Certain sections, such as indemnities, liabilities, and personal data, remain in effect even after termination.

Liability and Indemnification

Representation
You authorize us to act as your representatives to manage bookings with your clients. However, you remain solely responsible for providing your services to clients, and any failure to meet their expectations is your responsibility.

Exclusion of Indirect Damages
We are not liable for indirect or consequential damages, such as loss of revenue, contracts, goodwill, data, or other intangible losses, which may arise from:

  • The use or unavailability of the Services
  • Unauthorized access to your data
  • Actions of third parties related to the Services.

Indemnification
You agree to indemnify us for any losses, damages, or liabilities that may arise from:

  • Your violation of these terms
  • Any third-party claims related to your services, such as copyright infringement
  • Your actions or omissions, or those of third parties acting on your behalf.

Confidentiality
Both we and you agree to keep confidential the information shared between us and not disclose it without consent, unless required by law. Any passwords must be kept secure and not shared.

Audits
We reserve the right to conduct audits to ensure compliance with the terms.

Complaints
If you have any complaints, contact us at support@bookngo.gr. We will strive to resolve the issue as quickly as possible.

Notices
Any notices must be sent in writing via email or post. They will be considered successful 24 hours after being sent by email, or 48 hours after being posted by mail.

Third Parties
These terms do not create any rights for third parties unless explicitly stated.

Right to Amend
We reserve the right to amend these terms as necessary, by notifying you. The new terms will be published on our website.

Change of Ownership
In the event of a change in ownership of your business, you must inform the new owner of these terms and notify us promptly. Unless otherwise agreed, the new owner/manager will be responsible for all your obligations under these Terms.

Severability
If any term is deemed invalid or unenforceable, the remaining terms will continue to apply.

The Agreement
These terms, in conjunction with our Privacy Policy and Cookie Policy, and the Terms and Conditions for Bookings, supersede all previous versions.

Governing Law
These terms are governed and interpreted according to Greek law. Any disputes arising from these Terms will be exclusively resolved by the competent Greek courts of Agrinio.
